Terms of Use

These Terms of Use (the “Terms”) govern your use of the Mailtrove mobile application (the “App”) provided by HO CHIU FUNG (“we”, “us”, or the “Service Provider”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on a device that you own or control, in accordance with the Apple Media Services Terms and Conditions.

2. Paid features

The App is currently free. If paid plans or in-app purchases are introduced, their prices and terms will be shown in the App before purchase, purchases will be processed by Apple, and these Terms will be updated.

3. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) upload content you do not have the right to process; (c) reverse engineer, decompile, or disassemble the App; (d) interfere with or disrupt the App or its servers; or (e) use the App to violate the rights of any third party.

4. Your Letters and AI Processing

You keep all rights to the letters and documents you add. To provide the App’s features, photos and text are processed by a third-party AI service (Google Gemini on Vertex AI) as described in the Privacy Policy. Your letters are stored on your device; you are responsible for keeping backups.

AI can make mistakes. Transcriptions, summaries, dates and answers are generated automatically and may be incomplete or incorrect. Always check important information — such as deadlines, amounts and legal or medical matters — against the original letter. The App does not provide legal, financial or medical advice.

5. Disclaimers

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

6. Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, or any loss arising from reliance on AI-generated content, whether incurred directly or indirectly, arising from your use of or inability to use the App. Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid for the App or in-app purchases in the twelve (12) months preceding the claim.

7. Changes to the App and Terms

We may modify, suspend, or discontinue the App at any time. We may also update these Terms from time to time by posting the revised version. Your continued use of the App after changes constitutes acceptance of the revised Terms.

8. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App if you violate these Terms.

9. Apple as Third-Party Beneficiary

You acknowledge that these Terms are between you and the Service Provider, and not with Apple. Apple is not responsible for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. Any maintenance, support, warranty, product liability, intellectual-property, and end-user obligations shall be governed by the Apple Media Services Terms and Conditions and the applicable provisions of the Apple Developer Program License Agreement, in addition to these Terms.

10. Governing Law

These Terms shall be governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws provisions. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
